Karnataka Homebuyers Seek Stronger RERA Enforcement for Ownership Rights

Homebuyers in Karnataka have raised concerns over delays in conveyance deed transfers and ownership rights, urging stricter enforcement of RERA provisions to protect apartment associations and residents.

Homebuyers in Karnataka have sought stronger enforcement of the Real Estate (Regulation and Development) Act, 2016, raising concerns over delays in securing legal ownership rights even after housing projects are completed. Representatives of apartment owners have highlighted persistent issues related to the transfer of conveyance deeds, undivided land share, and common areas to resident associations, despite existing legal provisions.

According to homebuyer groups, many developers continue to delay or avoid executing registered conveyance deeds in favor of apartment associations, leaving residents without formal ownership of land and shared facilities. This has resulted in legal uncertainty, difficulties in managing properties, and challenges during redevelopment or financing processes. Homebuyers argue that such delays contradict the intent of RERA, which aims to bring transparency and accountability to the real estate sector.

The Karnataka Home Buyers’ Forum has formally urged state authorities and urban development agencies to ensure strict implementation of Section 17 of RERA. This provision mandates developers to transfer common areas and execute conveyance deeds in favor of associations within a defined timeframe after project completion. The forum has pointed out that in many cases, even years after completion certificates are issued, ownership transfers remain pending.

Among the key suggestions put forward is empowering competent authorities to initiate the transfer of land titles and common areas if developers fail to comply within a specified period. Homebuyers have also proposed keeping the transfer charges nominal, noting that individual apartment purchasers already pay applicable stamp duties at the time of registration.

Additionally, the forum has recommended mandatory registration of all apartment associations with a designated authority and the issuance of unique identification numbers to improve governance and accountability. The introduction of standard bye-laws and independent oversight of association elections has also been suggested to ensure transparent functioning. Homebuyers have further called for the establishment of a dedicated appellate authority with civil court powers to address disputes related to apartment ownership and association rights.

Industry observers note that clearer enforcement mechanisms could improve buyer confidence, reduce disputes, and strengthen Karnataka’s residential real estate market. However, they also acknowledge that effective coordination between regulatory authorities and timely administrative action will be critical to addressing long-standing ownership-related concerns faced by apartment residents.
