In a recent decision, the Madras High Court made it clear that sub-registrars in Tamil Nadu have the power to deny home sites registration if they determine that the property in question does not have the required consent or does not comply with government regulations. Strengthening regulatory control and preventing unauthorized or unlawful layouts from becoming legitimate through registration are the goals of this ruling.
Justice S. Srimathy heard the matter and stressed that sub-registrars are responsible for confirming the validity of the properties being registered, not only documenting them. According to the court, the sub-registrar has the authority to refuse registration if a property belongs to one of the prohibited categories, which include government poramboke lands, unapproved layouts, or encroached land. The purpose of the Tamil Nadu Registration Act, which is to stop illegitimate or fraudulent real estate transactions, is strengthened by this interpretation.
The selling of unauthorized home sites throughout the state has raised concerns, which is why the High Court issued its directive. Developers and landowners have been observed selling plots in locations that do not adhere to planning codes in numerous districts. For such properties, buyers frequently run into issues getting bank loans or building permits. As a result, the court’s decision serves as a caution to buyers and developers alike to make sure they do their research before making any real estate purchases.
It is anticipated that the decision will help lessen conflicts pertaining to unlawful land development and enhance urban planning. The government hopes to increase accountability and transparency in the registration process by giving sub-registrars the authority to examine the legitimacy of land approvals and property papers.
The decision has been praised by legal experts, who point out that it may assist stop land fraud and shield legitimate purchasers from financial damage.
