Karnataka RERA Orders Casagrande Garden City to Refund ₹52.74 Lakh to Bangalore Homebuyer Over Unfair GST Charges

The Karnataka Real Estate Regulatory Authority (K-RERA) has directed Casagrande Garden City Builders Pvt Ltd to refund ₹52.74 lakh to a Bengaluru homebuyer after finding that the developer engaged in unfair trade practices related to GST billing. The order was issued on January 2, 2026, by a bench headed by Member G.R. Reddy, following a homebuyer complaint.

According to the regulatory authority, the builder repeatedly altered the cost breakup of the property and inflated the GST component, leading to an undue financial burden on the complainant. The Authority concluded that such conduct amounted to unfair trade practices under the Real Estate (Regulation and Development) Act, 2016, and is inconsistent with fair billing norms expected of registered developers.

The dispute centered around a RERA-registered project where the homebuyer alleged inconsistencies between the originally agreed pricing and the tax components ultimately charged. K-RERA observed that the developer’s approach was not transparent and did not comply with statutory billing standards. In response, the regulatory authority held that the homebuyer was entitled to a full refund of the excess amount charged on account of GST.

K-RERA’s order reflects the regulator’s continued emphasis on protecting homebuyer interests and ensuring transparency in real-estate transactions. In recent years, the Authority has issued multiple rulings in favour of buyers where builders have failed to comply with agreed pricing, delayed possession, or levied unfair charges. These measures are aimed at enhancing trust in regulated real-estate markets and ensuring that developers adhere to the Act’s provisions.

Under the RERA framework, registered developers are required to clearly disclose cost structures, including applicable taxes and charges, at the time of booking. Any variation from agreed terms — especially in tax components like GST — can lead to regulatory action if found to be unjustified.

The refund order reinforces homebuyer protections under K-RERA and sends a clear signal that inconsistent billing and unfair financial practices will be scrutinised and rectified. Buyers affected by similar issues can seek relief under the RERA regime, which continues to be a key avenue for dispute resolution in the real-estate sector.
