The Telangana Real Estate Regulatory Authority (TG RERA) has taken decisive action against BhuvanTeza Infra Projects, slapping a penalty of ₹6.45 lakh for marketing and selling apartments in its “Happy Homes‑1” residential project at Shamirpet without obtaining the mandatory RERA registration.
Key Findings and Violations
- Unauthorized Sales (2020–2023): TG RERA found that BhuvanTeza Infra promoted and collected payments for apartments in Happy Homes‑1 between 2020 and 2023, well before registering the project as mandated under Section 3 of the RERA Act.
- Misleading Assurances: Multiple homebuyers, including Appam Kiran Kumar and three others, filed complaints alleging that the builder misled them with brochures, site plans, and verbal commitments about speedy approvals from HMDA, RERA, and other authorities.
- No Development on Site: Despite collecting significant funds via cheque, cash, and online transfers — often without formal receipts or agreements — no construction activity was initiated at the project site. Homebuyers claimed that their refund requests were either ignored or met with vague responses and, in some cases, threats.
TG RERA Orders
- A fine of ₹6.45 lakh must be paid by BhuvanTeza Infra within 30 days.
- All development, marketing, or booking activities related to the Happy Homes‑1 project have been ordered to stop with immediate effect.
- The developer must refund the entire amount paid by the complainants along with 11% annual interest from the date of each payment. These refunds must be completed within 90 days.
Pattern of Non-Compliance
This is not the first instance of regulatory action against BhuvanTeza Infra. In a separate case, the developer was fined ₹14.9 lakh for similar violations in its Aura Velimala‑1 project. In that matter, over 60 homebuyers were awaiting refunds.
TG RERA reiterated its commitment to protecting homebuyers by enforcing strict penalties against developers who violate the Real Estate (Regulation and Development) Act. The authority also urged homebuyers to verify RERA registration before investing in any property.
