In a major relief for property owners across Karnataka, the state government has officially allowed regularisation of building plan deviations up to 15%. The amendment to the Karnataka Municipal Corporations (Amendment) Act aims to resolve long-pending issues faced by homeowners and developers due to minor deviations from approved building plans.
Earlier, only deviations of up to 5% were eligible for regularisation. With the new provision, homeowners can now legalise small variations in setbacks, floor area ratio (FAR), and building height that fall within the 15% limit. This move is expected to benefit thousands of property owners, especially in Bengaluru and other urban local bodies (ULBs), where minor deviations are common.
According to the revised rules, applicants seeking regularisation will need to pay a prescribed penalty based on the type of building and the extent of deviation. For residential buildings under city corporations, the penalty is ₹2,000 per square metre, while for commercial properties, it is ₹3,000 per square metre. In addition, violations related to car-parking provisions attract a fixed fine of ₹5,000 across all ULBs.
While the amendment covers most urban areas of Karnataka, the Greater Bengaluru Area (GBA) is currently excluded. The state’s town-planning department is working on a similar regulation specifically for Bengaluru, which will be rolled out after stakeholder consultations and official notifications.
Officials say this decision will help clear backlogs of building occupancy certificates and reduce demolition cases caused by small, unintentional deviations. It also aligns Karnataka’s urban building regulations with other Indian states that already permit limited regularisation.
By offering a structured and transparent route for compliance, the government aims to simplify the building approval process and promote accountability within the real-estate sector. This reform is expected to encourage greater adherence to legal norms while providing long-awaited clarity and relief to genuine property owners.
