The Karnataka government is set to introduce the Apartment Bill 2025, a new legislation aimed at improving legal clarity and strengthening the rights of apartment owners across the state. The proposed law is expected to replace the decades-old Karnataka Apartment Ownership Act, 1972, which many stakeholders believe no longer reflects the realities of modern urban housing.
With Bengaluru and other urban centres witnessing rapid growth in apartment living, the government has acknowledged the need for updated regulations to address long-standing issues related to land ownership, common areas, apartment association powers and dispute resolution. Officials have stated that the new Bill is intended to provide a more structured and transparent framework for apartment governance.
One of the key challenges under the existing law has been the lack of clarity on ownership and transfer of common areas and land to apartment associations. Resident welfare associations have also faced limitations in enforcing maintenance payments and managing shared facilities due to weak legal backing. The absence of a designated competent authority has further resulted in prolonged legal disputes, often forcing residents to approach civil courts.
The proposed Apartment Bill 2025 aims to resolve these concerns by clearly defining the rights and responsibilities of developers, apartment owners and associations. It is expected to introduce formal mechanisms for grievance redressal, improve accountability in apartment management and reduce conflicts between stakeholders.
To ensure the legislation reflects ground-level realities, the state government has initiated consultations with homebuyers’ groups, apartment owners and resident welfare associations. Feedback from these stakeholders will be considered before finalising the Bill. Officials have indicated that the objective is to create a balanced law that protects homebuyers while ensuring smooth functioning of apartment communities.
Experts believe that once implemented, the Apartment Bill 2025 could bring greater transparency to apartment ownership, improve governance standards and reduce litigation in the real estate sector. The Bill is expected to be tabled in the upcoming legislative session, and its progress is being closely watched by homebuyers, developers and real estate professionals across Karnataka.
