Undeveloped BDA layout highlights infrastructure delays as KRERA orders compensation to a homebuyer in Bengaluru.

The Karnataka Real Estate Regulatory Authority (KRERA) has ordered the Bangalore Development Authority (BDA) to pay ₹22.46 lakh in compensation to a homebuyer, citing failure to provide essential infrastructure in a residential layout. The directive follows a complaint regarding delays in delivering basic amenities despite possession being issued.

The case pertains to a site in the Nadaprabhu Kempegowda Layout, where the buyer had completed payments but was unable to utilise the property due to lack of infrastructure.

Timeline of Events

The homebuyer purchased the plot in 2018 and completed payment obligations by early 2019. Although possession was formally handed over in 2020, the layout continued to lack critical facilities such as water supply, drainage, electricity, internal roads, and street lighting.

KRERA observed that the absence of these amenities effectively prevented construction and occupation, making the possession non-functional from a practical standpoint.

Regulatory Observations

In its ruling, KRERA emphasised that possession without basic infrastructure does not meet the requirements under the Real Estate (Regulation and Development) Act, 2016. The authority directed BDA to compensate the buyer with interest calculated based on the SBI MCLR rate plus an additional percentage, covering the delay period.

The authority also instructed that the required infrastructure be completed within a specified timeframe to ensure usability of the layout.

Implications for Real Estate Practices

The order highlights the importance of delivering fully developed plots before handing over possession. It underscores regulatory scrutiny on both public authorities and private developers to meet commitments related to infrastructure and project timelines.

Such decisions are expected to influence how future layout developments are executed, particularly in ensuring that basic services are in place before buyers are granted possession rights.

Impact on Buyers and Development Standards

The KRERA ruling is expected to influence how layout projects are delivered across Bengaluru and other urban markets. By holding a public authority accountable for delays in basic infrastructure, the decision reinforces the importance of completing essential services before handing over possession. This may prompt developers and agencies to align project timelines more closely with infrastructure readiness, ensuring that plots are usable upon delivery.

The order also strengthens confidence among homebuyers, as it highlights the effectiveness of regulatory mechanisms in addressing grievances. Over time, such interventions could lead to improved planning, stricter compliance, and higher quality standards in real estate development, contributing to a more transparent and structured property market.

Sector Outlook

The ruling reflects ongoing efforts to strengthen accountability in the real estate sector. As regulatory bodies continue to enforce compliance, developers may adopt more structured timelines and quality benchmarks for project delivery.

This is expected to contribute to a more transparent and reliable property market, particularly in cities like Bengaluru where large-scale layout developments remain a key segment.
